The Trustee proposes to sell the estate’s interest in the property to the proposed Buyer on an “as-is,” “where-is” and “with-all-faults” basis without any warranties, expressed or implied, and without any contingencies, without any representations or warranties by the Trustee regarding the condition of the Property, with a finding that Buyer is a good faith buyer per §363(m), free and clear of all liens, claims, interests and encumbrances, with such liens, interests, claims, and encumbrances to attach to the Sale proceeds, net of expenses of sale, with the same priority and rights of enforcement as previously existed pursuant to sections 363(b), (f), and (m) of the United States Bankruptcy Code for a purchase price of $305,000. Potential purchasers seeking to submit an overbid must so inform Trustee and counsel at least 2 days prior to hearing. A deposit in form of a cashier’s check payable to “David Seror, Ch. 7 Trustee” for $15,000 must be delivered to trustee’s counsel at or before hearing. Initial overbid shall be at least $10,000.00 (i.e. $315,000), with subsequent overbids in minimum increments of $5,000.00.
