The Debtor proposes to sell the estate’s interest in the property to the proposed Buyers pursuant to 11 U.S.C. § 363(b)(1) and (f) free and clear of liens, interests, claims, and encumbrances, with such liens, interests, claims, and encumbrances to attach to the sale proceeds with the same priority and rights of enforcement as previously existed. The proposed sale price is $425,000.00, subject to overbid pursuant to the Overbid Procedures set forth in the Sale Motion. Sale is on an “AS-IS” and “WHERE-IS” basis, without warranties or representations. Potential purchasers seeking to submit an overbid must contact counsel for the Debtor no later than 5:00 p.m. PT on September 24, 2018 pursuant to the Bid Procedures described in the Sale Motion. Initial overbid is $425,000.00, without any credits toward the buyer’s closing costs, and with subsequent overbids in increments of $5,000.00. To be qualified overbidders, potential overbidders must submit to the Debtor’s counsel a deposit of $12,750 in the form of a cashier’s check at or prior to the hearing on the Sale Motion.
